With reference to your letter of the 2nd September (49033/19) regarding lir. C.. Falk, I am directed by the Board of Trade to state, for the information of Viscount Lilner, that if ́lir, Falk wants a general exemption from Defence of the Realm Regulation No.39D, he should send an application to the Admiralty, for consideration by the Alien Lasters Committee. This Committee may possibly be able to deal with the application without personal attendance, if satisfactory evidence is sent to justify exemption.
As regards the enquiry in the last paragraph of your letter, the Board are disposed to think that Defence of the Realm Regulation No.37D applies to a British ship, wherever trading, but is probably only enforceable if the person offending against it is in the jurisdiction of the United kingdom; the point is, however, one which would have to be settled by a decision of a Court of Law.
